2. This application under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 filed by the petitioner, namely Jahangir Hussain, apprehending arrest in connection with Kajalgaon P.S. Case No. 154/2025 registered under Sections 319(2)/ 296/ 64/ 351(2) of BNS, 2023.
3. The gist of the case as has been narrated in the FIR is that the informant was in love relationship with the accused applicant and they had physical relationship. The accused applicant promised to marry the informant and there
Page No.# 2/2 was a meeting between the families of the informant as well as the accused applicant and a decision had been taken that both the accused applicant and the informant will marry each other. However, when the accused applicant and the informant alongwith their families went to court for getting their marriage registered, the father of the accused applicant objected to such marriage and therefore, the marriage could not take place and in view of the aforesaid, the informant had filed the FIR alleging cheating and other offences.
4. The learned counsel for the accused applicant submits that the marriage could not be registered on that particular date due to certain objections made by his father and in fact the accused applicant is still agreeable to marry the informant. He further submits that he did not have any intention of cheating the informant and all the way he has been supporting the informant.
5. The learned Addl. Public Prosecutor has submitted that pursuant to the interim protection, the petitioner has appeared before the I.O. and his statement has been recorded and subsequently, the charge sheet has been submitted.
6. Keeping in view of the nature of the allegation and the fact that the petitioner has cooperated with the investigation, interim order dated 17.10.2025 is hereby made absolute subject to the conditions mentioned in the said interim
order at serial No. (ii) and (iii).
