This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…..pleased to issue and appropriate Writ, Order or direction, more particularly one in the nature of Writ of MANDAMUM or any other writ by declaring the action of the 3rd and 4th respondents in interfering with the possession and enjoyment and threatening to evict the petitioner by demolishing the part of house in D.No.:1-14T, Sy.No. 105-3 of T. Jaggampet Village, Kotauratia Mandal, Anakapalli District, Visakhapatnam at the instance of the 7th, 8th and 9th respondents without following due process of law as wholly illegal, arbitrary, unjust, untenable, contrary to principles of natural justice besides being violative of Articles 14, 21 and 300-A of constitution of India and consequently direct the respondent authorities to not to interfere with the possession of the petitioners over their house property bearing D.No:1-14T, in Sy. 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader appearing for the respondents. 3.
Learned counsel for the petitioner submits that the petitioner is the absolute owner and possessor of the house site property admeasuring to

an extent of 187.62 Square Yards in Sy.No.105-3 of T.Jaggampeta Village, Kotauratla Mandal, T.Jaggampeta Sub-Division, Anakapalli, Visakhapatnam. The subject property was acquired by the petitioner through a registered sale deed bearing Document No.1792/2020, dated 07.07.2020. While so, the respondent authorities, without issuing any notice, are trying to interfere with the peaceful possession of the petitioner in respect of the subject property. Hence, the Writ Petition. 4. Learned Assistant Government Pleader submits that the respondents will follow due process of law as contemplated, if they intend to dispossess the petitioner from the subject property. 5. Having regard to the submissions of the learned counsel for the petitioner, the learned Assistant Government Pleader for the Revenue and on perusal of the material available on record, this Court is of the considered opinion that the present Writ Petition can be disposed of directing the respondents to follow due process of law, if they intend to dispossess the petitioner from the subject property. 6. In the result, the Writ Petition is disposed of. There shall be no order as to costs.
