(At Present Petitioner Lodged In Central Alwar). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent Connected With S.B. Criminal Miscellaneous Bail Application No. 583/2025 Sachin Kumar @ Dholiya S/o Ashok, R/o Tehadka, Police Station Tatarpur, District Khairthal, Tijara. ( At Present Confined In Sub Jail Kishangarh Bas). ----Petitioner Versus State Of Rajasthan, Through P.p. ----Respondent For Petitioner(s) : Mr. Mahendra Shandilya Mr. Sumer Singh Ola For Respondent(s) : Ms. Arti Sharma, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 20/01/2025 1. Petitioners have filed these bail applications under Section 483 of BNSS. 2. F.I.R. No. 0609/2024 was registered against the petitioners at Police Station Mundawar, District Alwar, Rajasthan for the offences punishable under Sections 115(2), 126(2), 324(5), 3(5), 110 & 118(1) of BNS. Later on, the police filed the charge-sheet in this (2 of 3) [CRLMB-222/2025] matter for the offences under Sections 115(2), 126(2), 324(5) & 3(5) of BNS, 2023. 3. It is contended by learned counsel for the petitioners that the accused-petitioners have falsely been implicated in this case. Counsel further submits that all the injuries sustained by the injured have been found simple in nature. Petitioners are in custody since 17.12.2024. Two criminal cases have been registered against the petitioner-Ankur and one case has been registered against the petitioner Sachin Kumar @ Dholiya and they are on bail in that case. Charge-sheet has been filed and trial will take considerable time. Further custody of the petitioners would not serve any fruitful purpose. 4. Learned Public Prosecutor opposes the submissions made by counsel for the petitioners. She submits that there are serious allegations against the petitioners to cause injury on the head of the injured, who is 61 years old person. 5. I have considered the contentions. 6. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the parties, especially the fact that charge-sheet has been filed; petitioners are in custody since 17.12.2024 and trial will take time in its conclusion but without commenting anything on merits and demerits of the case, I deem it proper to allow these bail applications. 7. These bail applications are accordingly allowed and it is directed that accused-petitioners- (1) Ankur S/o Shri Satish Kumar & (2) Sachin Kumar @ Dholiya S/o Ashok shall be (3 of 3) [CRLMB-222/2025] released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 8. It is made clear that accused-petitioners shall not involve in any other similar offence during currency of the bail. Breach of this condition would entail cancellation of the bail granted to the accused-petitioners. (ANIL KUMAR UPMAN),J ANAND TANWAR /260-261
