This writ petition has been filed with the following prayer:- "I. to direct the Learned Additional Civil Judge (S.D.), Court No. 2, Ghaziabad to decide the Execution Case No. 03 of 2020 (Leeladhar Sharma Versus Mohammad Nazir), pending before him, within specific period as directed by this Hon'ble Court." In the suit instituted by the plaintiff-petitioner in the year 2010, judgment and decree was passed on 18.12.2017. Against the judgment of the trial Court, no appeal or any proceeding was initiated by the defendant-respondent. An Execution Case No.03 of 2020 was filed by the decree-holder which is pending consideration. The sole prayer made in the writ petition is for early disposal of Execution Case No.03 of 2020. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction upon Additional Civil Judge (Senior Division), Court No. 2, Ghaziabad to decide the Execution Case No.03 of 2020, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of four months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
