PRAYING TO QUASH FIR IN CR.NO.221/2019 FILED BY THE RESPONDENT TAVAREKERE POLICE AGAINST THE PETITIONER FOR THE OFFENCE P/U/S 498A OF IPC AND SEC.3, 4 OF D.P ACT AND TO QUASH THE PROCEEDINGS IN C.C.NO.1197/2020 ON THE FILE OF CHIEF JUDICIAL MAGISTRATE RURAL COURT AT BENGALUR, BY ALLOWING THE ABOVE PETITION.

ORAL ORDER Petitioners/accused Nos.1 to 5 have preferred this petition under Section 482 of Cr.P.C., praying to quash the FIR in Crime No.221/2019 of Tavarkere Police station registered for offences punishable under Section 498A of IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961, and the consequent proceedings pending in C.C.No.1197/2020 on the file of the Chief Judicial Magistrate, Rural Court, Bengaluru.
2. The petitioners are the husband and in-laws of respondent No.2. The complaint is lodged alleging that the marriage of respondent No.2 with accused No.1 was performed on 02.02.2018 by spending huge amount and at the time of marriage, the accused demanded and accepted dowry and after the marriage, they subjected the complainant to cruelty in connection with dowry etc.,

Learned counsel for the petitioners submitted that the parties have settled the matter before the Family Court, Bengaluru, in M.C.No.6288/2021, wherein, they have filed Memorandum of Settlement and the Family Court has allowed the petition filed under Section 13(B) of the Hindu marriage Act, 1955 and dissolved marriage of respondent No.2 and petitioner No.1, solemnized on 02.02.2018.
4. Copy of the decree dated 22.12.2021 passed in MC.No.6288/2021 by the Principal Judge, Family court, Bengaluru and the Memorandum of settlement filed in the said case are produced along with the petition.
5. It is relevant to extract clause 6 of Memorandum of Settlement, which reads as under;
"6. In view of the settlement agreement, the 1st petitioner has agreed to cooperate in closing/quashing the proceedings in C.C.No.1197/2020 pending before the Chief Judicial Magistrate, Bengaluru filed under Section 498A of IPC. In this regard, the 2nd petitioner has filed Crl.A.No.6768/2021 before the Hon'ble High Court of Karnataka, Bengaluru. The 1st petitioner has agreed to cooperate in closing the said criminal case."

6. The petitioner No.1 before the Family Court is respondent No.2 herein. She has undertaken to close the current proceedings pending before the Trial Court in C.C.No.1197/2020. Hence, no purpose will be served in keeping the proceedings pending against the petitioners, as the dispute has been settled. Therefore, in the interest of justice, the impugned proceedings are liable to be quashed. Accordingly, the following order;
ORDER The petition is allowed. The entire proceedings pending in C.C.No.1197/2020 before the Chief Judicial Magistrate, Rural Court, Bengaluru arising out of Crime No.221/2019 of Tavarekere Police station, registered for the offence punishable under Section under Section 498A of IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961, are hereby quashed.
