1. Heard Mr. M Ali, learned counsel for the petitioners. Also heard Mr. R.J Baruah, learned Addl. Public Prosecutor for the State of Assam. Page No.# 2/3

This is an application filed u/s 483 of the BNSS, 2023 praying for grant of bail to the petitioners namely, (1) Abdul Barek and (2) Ariful Islam, who were arrested on 18.11.2025 in connection with Hatigaon P.S Case No. 202/2025 u/s 316(2)/318(4) BNS, 2023. 3. The gist of the allegations in the FIR dated 18.11.2025 is that source information was received about involvement of some persons in dealing with fake gold, whereupon, G.D No. 10 dated 18.11.2025 was made in Hatigaon P.S and search was conducted in the residence of both the above named petitioners and in the presence of witnesses, gold suspected to be fake weighing 614 grams was recovered. 4. In the ground of arrest at the time of forwarding, it is stated that the accused persons are involved in selling of fake gold to persons and that a fake gold selling racket in active in Guwahati and other parts of the State and for which, investigation is being conducted with a view to dismantling the nexus. 5. The learned counsel for the petitioners submits that considering the length of detention, they may be granted bail. 6. With regard to petitioner No. 1 namely Abdul Barek, it is submitted that his wife is expecting a delivery in the month of February 2026. 7. I have heard learned counsel for both sides and perused the relevant documents. 8. The learned Addl.
Public Prosecutor for the State of Assam, who is opposing the bail, submits that the suspected fake gold has been
Page No.# 3/3 sent to Forensic Science Laboratory, Kahilipara for investigation and the investigation including the statements of the accused persons also lend support to the allegations about involvement of fake gold selling activities and investigation into the involvement of other persons is also being looked into. 9.
