RespondentlComplainant Petition under Sections 482 of BNSS (old 438 of Cr.P.C), praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to enlarge the Petitioner/Accused No. 2, on Anticipatory bail in the event of their arrest by the S.H.O. of the Kovvur Rural P.S., and its staff in FIR vide Cr.No.02 of 2025. r The petition coming on for hearing, upon perusing the petition and the grounds filed in support thereof and upon hearing the arguments of Sri PARIMI RAMA RAYUDU, Advocate for the Petitioner and of PUBLIC PROSECUTOR for the Respondent and the Court made the following; ORDER:- The instant Criminal Petition, instituted under Section 482 of Bharatiya Nagarik Suraksha Sanhita (in short tBNSS'), is filed on behalf of the petitioner/A2 to grant anticipatory bail in COnneCtiOn with crime No.2 of 2025 of Kowur Rural Police Station, East Godavar'l Distr-lct, registered for the OffenCeS Punishable under Section 109 (1) r/w 3(5) of BNS. 2. The case of the prosecution iS that the Petitioner/A2 and defacto complainant are own brothers and there are civil disputes between the family. on o2.01.2025, at about 12.00 pm wh'lle the defacto complainant cultivating his land, petitioner/A2 approached him and abused him in filthy language and caused bleed'Ing -Injuries to the defacto complainant. Thus, FIR was emanated. 3. Apparently, the learned COunSel for the Petit'lOner contends that even as per the version of the FIR, there are no specific allegations attributed against the petitioner/A2. Further, he contends that there are civil disputes among them and the petitioner herein is aged about 68 years. t'-` _,r`-_--_-__ rf-- efzFZfZ? 4. As seen from the material, there are centrifugal aIIegat,Ions made in FIR against A.1 only. it appears that the petitioner/A2 is none other than the own brother of the defacto complainant aged about 68 years. on a consideration of the facts and cl-rcumstances in the lis, as there are no specI®fiC overt acts attributed against the petitioner/A2 I'n respect Of Section 109(1) r/w Clause 3(5) of BNSS, thl's Court l's inclined to enlarge the petitioner on bail with the following conditl-ons:- i. The petitioner is directed to surrender before the SHO, Kovvur Rural Police Station, East Godavarl® District, wl®thin 15 days from the date of receipt of order. I'i. On such surrender, the SHO, Kovvur Rural PoII'Ce Station, shall enlarge the petI-tiOner On bail on his executing a personal bond for a sum of Rs.10,000/-(Rupees Ten thousand only) wl'th two SuretI'eS for the like sum each to the satisfaction of the said Court; iii. The petitioner shall appear before the lnvestl-gating officer once in a month, I-.e. on lst Sunday of every month between 10.00 AM and 1.00 PM for a period of three months or till fl-ling of the charge sheet, whichever is earlier; I- _ Qfro lV. The petitioner shall make himself available for investigation by a police officer as and when required, and he shall not, directly or indirectly, make any induc6ment, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer; and The petitioner shall not indulge jn similar acts of crime.
