The Court made the following: HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.20461 of 2025 ORDER: This writ petition is filed questioning the issuance of impugned G.O.Ms.No.5 Grama Sachivalayam and Ward Sachivalayam Department dated 12.06.2025 contrary to the principles of transfers enunciated in G.O.Ms.No.23 Finance and Planning Department dated 15.05.2025 as illegal and arbitrary and consequently revise of G.O.Ms.No.5 dated the transfers effected in pursuance 12.06.2025. 2. The facts leading to the filing of the writ petition are that; The 1®' Petitioner was initially joined on 11.10.2019 as Welfare and Education Assistant in Social Welfare Department at Tempalli Sachivalayam, Gannavaram, Krishna District, was appointed on 07.10.2019 as Welfare and Education Assistant in Social Welfare Department at Nadupuru, Pedana Mandal, Krishna the Government had issued G.O.Ms.No.23 The 2'^'^ Petitioner District. While so, Finance and Planning Department dated 15.05.2025 framing certain for transfers. Consequently, the Department of Grama guidelines Sachivalayam and Ward Sachivalayam formulated separate transfer guidelines and issued G.O.Ms.No.5 Grama Sachivalayam and Ward 2 Sachivalayam Department dated 12.06.2025 in terms of G.O.Ms.No.23 dated 15.05.2025. 3. Learned counsel for the Petitioners would submit that certain clauses in G.O.Ms.No.5 dated 12.06.2025 are not in consonance with G.O.Ms.No.23 and taking advantage of the same, transfers were effected without issuing any list of places for counseling. Learned counsel would further submit that the Petitioners had given representations through the employee association, however, they are not being considered. Learned Government Pleader would contend that the transfer is an incident of service and that the authorities would consider the representations subject to the prevailing guidelines and rules. 4. Having heard the respective counsel, the writ petition is disposed of with the following directions: 5. (i) The Petitioners shall make a representation to the Respondent- authorities within a period of one week from the date of receipt of a copy of this order explaining their grievance with regard to the order of transfer. 3 (ii) On receipt of the representations, the Respondent-authoriti es shall consider the case of the Petitioners and pass appropriate orders as expeditiously as possible, preferably within four (4) weeks.
