A S C BOSE (SC FOR MUNICIPAL CORPORATIONS AP) The Court made the following: 2 ORDER : This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “.... to issue a writ, order or direction more so a writ in the nature of mandamus by declaring the inaction of the respondents in not considering the application of petitioner for grant of building permission and releasing of sanction plan by considering the petitioner’s application No.2014-TP-0644, dated 14.08.2014 for H.No.25-5-60, 3rd Street, Sanjay Gandhi Nagar, Nellore as arbitrary, illegal, unlawful and consequentially to direct the 2nd respondent to release the sanction plan as per the application of petitioner...” 2. Heard learned counsel for the petitioner and the learned Standing Counsel for Municipal Corporation for respondent No.2. 3. Today, when the matter came up for hearing, learned Standing Counsel for respondent No.2 furnished a copy of instructions of the Deputy City Planner, Nellore Municipal Corporation dated 03.01.2025, wherein it is stated that in pursuance of the application made by the petitioner on 14.08.2014, the 2nd respondent/Commissioner, SPSR, Nellore District issued building permission vide B.A.No.644/2014/G3, dated 30.08.2014. 4. In view of the same, this Court feels that no further cause survives in this writ petition. 5. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
