This petition has been filed for restoration of W.P.(Cr.) No.161 of 2023, which was rejected on 16.08.2023 for non-compliance of the order dated 26.07.2023 passed in the said criminal writ petition. 3. Learned counsel appearing for the petitioner submits that the said case was defective and notice was not issued upon the opposite party no.2. He submits that now the defects have already been removed by way of filing certified copy of Annexure-2 in the said criminal writ petition. He submits that there was some delay and in view of that, the said criminal writ petition was rejected. 4. Learned counsel appearing for the State has got no serious objection. 5. Considering that in the said criminal writ petition, notice was not issued upon opposite partyno.2 and at the initial stage, the matter was defecting and in light of the peremptory order, the said petition was rejected, the Court finds that sufficient ground is made out to restore the said petition. As such, W.P.(Cr.) No.161 of 2023 is restored to its original file. 6. Accordingly, this petition is disposed of. (Sanjay Kumar Dwivedi, J.) Ajay/
