GP FOR HOME 2 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the acts, deeds and things of the Respondents and their subordinates, by calling them to the Police Station and confining hours together without any F.I.R. pending against them and without following the due process of law, even though there is no any cognizable offence committed by the Petitioners and interfering the Petitioners' day to day life, which is nothing but illegal, irregular, arbitrary, un-constitutional and exceeding the jurisdiction conferred with them under the Criminal Procedure Code or any law for time being in force and is violation of Article 14, 19, 21 of Constitution of India and also the law laid down by this Hon'ble Apex Court.” 2. Sri Ch.Venkat Raman, learned counsel for the Petitioners would submit that Police are repeatedly calling the Petitioners to the Police Station and are confining them hours together without there being any case registered agaisnt them. 3. Sri V.Farooq, learned Assistant Government Pleader for Home, would submit that the Police are not calling the Petitioners to the Police Station. 4. Considering the submissions, the Writ Petition is disposed of directing the Police not to call the Petitioners to the Police Station, in the absence of any crime registered against them. There shall be no order as to costs.
