The Labour Court has directed petitioner's reinstatement without back wages, but withholding two annual increments while granting continuity of service and all consequential benefits. The petitioner and the respondent have come to terms, and have filed a Joint Memo, which in its material part reads as under: "The petitioner herein has paid to the respondent, on this date a sum of Rs. 3,50,000/- (Rupees Three Lakhs & Fifty Thousand) vide cheque No. "293146" dated 05th April 2025, drawn on HDFC Bank, Mysuru and a cheque for Rs. 1,50,000/- (Rupees One Lakh & Fifty Thousand) vide cheque No. "293147" dated 05th April 2025, drawn on HDFC Bank, Mysuru, totaling to Rs. 5,00,000/- (Rupees Five Lakhs), in full and final settlement of all the claims of the - 3 - NC: 2025:KHC:14698 WP No. 15093 of 2024 respondent which shall include the claim of the respondent, towards reinstatement, back wages, continuity of service, consequential benefits, gratuity, leave encashment, post superannuation benefits as per settlement dated 07/09/2023 and all or any other monetary benefit or otherwise which he would be entitled during the course of employment. The respondent herewith acknowledges receipt of a sum of Rs.3,50,000/- (Rupees Three Lakhs & Fifty Thousand) vide cheque No. "293146" dated 05th April 2025, drawn on HDFC Bank, Mysuru and a cheque for Rs. 1,50,000/- (Rupees One Lakh & Fifty Thousand) vide cheque No. "293147" dated 05th April 2025 drawn on HDFC Bank, Mysuru, totaling to Rs. 5,00,000/- (Rupees Five Lakhs), in full and final settlement of all his claims which shall include his claim towards reinstatement, back wages, continuity of service, consequential benefits, gratuity, leave encashment, post superannuation benefits as per settlement dated 07/09/2023 and all or any other monetary benefit or otherwise which he would be entitled during the course of employment." The petitioner's representative, Sri Praveen K S [AGM-HR], is present and so is the respondent, and - 4 - NC: 2025:KHC:14698 WP No. 15093 of 2024 both of them reiterate that the dispute stands settled in the above terms. In fact, two cheques for a total sum of Rs.5 lakhs are handed over to the respondent. In the light of the afore, accepting the terms of settlement and modifying the Labour Court's Award dated 03.01.2024 in IID No.27/2021 accordingly, the petition stands disposed of.
