The petitioner is apprehending his arrest in connection with Govindpur P.S. Case No.126 of 2022, for the alleged offences registered under Sections 379, 413, 414 and 34 of Indian Penal Code and Section 30(ii) of Coal Mines Act pending in the Court of learned Judicial Magistrate 1st Class, Dhanbad. 3. Learned counsel appearing for the petitioner submits that the petitioner is the owner-cum-driver of truck bearing Registration No. JH-02AB-3261 and the allegations are made of carrying of coal. He further submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.19 of the petition. He then submits that in identical situation co-accused persons have already been granted anticipatory bail in A.B.A. Nos.4699 of 2022, 5775 of 2022, 7123 of 2022 and 7594 of 2022. 2025:JHHC:30006 --2-- A.B.A. No. 5733 of 2025 4. Learned counsel appearing for the State opposes the prayer and submits that illegally the coal was being carried. 5. Considering that the petitioner is the owner-cum-driver of truck and the petitioner has got no criminal antecedent as disclosed in paragraph No.19 of the petition and in identical situation co- accused persons have already been granted anticipatory bail in the aforesaid A.B.A., I am inclined to provide anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Dhanbad in connection with Govindpur P.S. Case No.126 of 2022, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated 25.09.2025 Sangam/
