Order No. 5/Dated: 12th August 2025
The instant writ application has been preferred by the petitioner for the following reliefs:
“a. The petitioner is a retired headmistress from BIT +2 High School, Meshra, Ranchi and after completing of more than 37 years of satisfactory and unblemished service retired on 31.03.2019 prays for direction upon the respondent authorities for payment of higher/revised pay scale in the pay scale of 9300-34,300 in the grade pay of 5400 which is payable after 24 years of satisfactory service and the same has also been duly accepted by the respondents and notified the same vide order bearing memo no. 1655 dated 28.07.2020 (Annexure-4) and after revision pay the benefits of revised scale and the consequential benefits. b. petitioner in the aforesaid scales and thereafter revise the pension of the petitioner and pay the difference of salary as well as pension.
And/or Pass such order/orders as Your Lordship may deem fit and proper in the interest of justice.”
2.
At the outset, learned counsel for the petitioner draws attention of this Court towards Annexure-4 to the writ application and submits that the claim of the petitioner has already been admitted which is evident from paragraph no. 1 of Annexure-4 read with Serial No. 145 where the name of this petitioner is indicated and entitlement of pay-scale of Rs. 9300-34800/-, Grade Pay of Rs.5400/- has been shown to be admissible from 01.04.2006 itself.
3.
Grievance of the petitioner is that though Anenxure-4 clearly indicates that the petitioner is entitled for the above referred pay- scale from 01.04.2006 itself but this benefit is given only on this paper and actual monetary benefit has not been extended to the petitioner till date which forced her to knock the door of this Court.
4.
Learned counsel for the respondent-State fairly submits that though from Annexure-4 it is clear that the entitlement of the petitioner for the pay-scale of Rs. 9300-34800 and Grade Pay Rs. 5400/- has been shown to be admissible from 01.04.2006 but since no counter affidavit has been filed as such, he is not able to inform this Court as to whether the actual payment has been given. Learned counsel for the respondent-State submits that the concerned respondents be directed to look into the matter.
5.
Having regard to the aforesaid facts and the submissions made by learned counsel for the parties and after perusing Annexure-4 to the writ application, which is an office order bearing Memo No. 1655 dated 18.07.2020, wherein the District Education Establishment Committee has taken an unanimous decision for extending the benefit of higher pay scale to those teachers who have completed 24 years of satisfactory service and the name of the petitioner has been indicated at Serial No. 145. Thus, it seems there is no reason as to why the fruits of the
order dated 18.07.2020 has not been extended to the petitioner.

The entire exercise shall be completed within a period of six weeks from the date of receipt/production of copy of this order, since the petitioner is retired Headmistress. The respondents are further
directed to revise the pension accordingly within the aforesaid stipulated period.
