[2025:RJ-JP:32001] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 9793/2025 Bajrang S/o Kuka Lal, R/o Village Rampuriya, Police Station Begu, District Chittorgarh (Rajasthan) (At Present Confined In District Jail Bundi). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Ms. Anushree Sharma For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 14/08/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 07/2025 registered at Police Station Dabi, District Bundi for the offences under Sections 8/15 and 8/29 of NDPS Act and Sections 318(4) & 336(2) of BNS. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. The accused-petitioner is implicated solely upon the disclosure statement of the other co-accused, the recovery of the contraband article was effected from Amandeep and Sharwan. There is no connecting evidence available on record indicating that the petitioner and the other co-accused were transporting the commercial quantity of poppy straw in the vehicle. The charge- sheet against the petitioner has already been produced and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. [2025:RJ-JP:32001] (2 of 2) [CRLMB-9793/2025] 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that the petitioner in connivance with the other co-accused has involved in transporting the commercial quantity of poppy straw which was recovered from the other co- accused and they have named the petitioner, therefore, considering the above facts, the bail application of the accused- petitioner may be dismissed. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the petitioner and that the recovery of the said poppy straw was effected from the other co-accused and not from the accused- petitioner and apart from the disclosure statement of the other co- accused, there is no substantive piece of evidence available on the record indicating the petitioner involvement in the present case, there are no criminal antecedents against the petitioner, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Bajrang S/o Kuka Lal, in connection with FIR No. 07/2025 registered at Police Station Dabi, District Bundi, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
