1. Heard Mr. F Hoque, learned counsel for the petitioner. Also heard Mr. R J Baruah, learned Additional Public Prosecutor for the State.
2. This is an application under Section 480 of BNSS, 2023 for granting of pre-arrest bail to the petitioner, namely Norjul Islam @ Nazrul Islam, in
Page No.# 2/3 connection with PRC Case No. 192/2020, under Section 344/376(D)/313/506 IPC.
3. The facts in disclosed during investigation are that the victim was taken to Bangalore on the promise of a job, where she worked in a factory for about two months and fifteen days. During this period, accused Sattar Ali and the present petitioner, Norjul Islam, allegedly committed rape upon her, due to which she became pregnant. Subsequently, accused Sattar Ali took her to a hospital, where she was allegedly forced to undergo an abortion. It appears that the version of the victim in her FIR and her statements before the Police and the Magistrate differ in material particulars and contradict one another.
4. Having regard to the aforesaid facts and circumstances, and the fact that the charge-sheet has already been submitted, the detention of the petitioner in custody is not necessary.
5. Having regard to the above, the above named petitioner shall be allowed to go on bail of Rs. 20,000/- only with one surety each of the like amount, subject to the satisfaction of the learned CJM Kamrup, Amingaon with the following conditions: (i) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person who may be acquainted with the facts of the case so as to dissuade such person from disclosing such facts of the case before the Investigating Officer.
