02/ 24.09.2025: Heard learned counsel for the petitioner and learned counsel for the JUVNL.
2. The petitioner is apprehending his arrest in connection with Itkhori P.S. Case No. 51 of 2019, corresponding to Electricity Case No. 26 of 2019, registered under sections 379, 414, 34 of I.P.C. and section 136 of Electricity Act, pending in the Court of learned Additional District & Sessions Judge-IV, Chatra.

Learned counsel for the petitioner submits that petitioner is owner of the car and allegations are made that in the said car the person who was sitting, has instigated to take away the electrical pole by using crane. He further submits that even the pole was not taken away. He then submits petitioner has no criminal antecedent which is disclosed in para 13 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the JUVNL opposes the prayer and submits that the name of the petitioner has come in the confessional statement.

Considering that petitioner is owner of the car and allegations are made that petitioner instigated to take away the electrical pole however, the electrical pole was not taken away. The petitioner has no criminal

antecedent which is disclosed in para 13 of the petition.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Additional District & Sessions Judge-IV, Chatra, in connection with Itkhori P.s. Case No. 51 of 2019, corresponding to Electricity Case No. 26 of 2019, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
