DISTRICT. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased tomay be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the Respondent No.l in not registering the FIR in pursuant to the complaint dated 07-06-2025 made by the Petitioner against the Respondent No.4 to 6 even in spite of the contents of the complaint clearly disclose the commission of the cognizable offences as arbitrary, illegal and contrary to section 173 of BNSS and consequently direct the Respondent No. 1 to register the FIR based on the complaint dated 07-06-2025 made by the Petitioner against the Respondent No.4 to 6 forthwith and proceed with the investigation in accordance with law in the interest of justice. IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the Respondent No.l to register the FIR in pursuant to the complaint dated 07-06-2025 made by the Petitioner against the Respondent No.4 to 6 forthwith pending disposal of the Writ Petition in the interest of justice. This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the Respondent No.1 in not registering the FIR in pursuant to the complaint dated 07- 06-2025 made by the Petitioner against the Respondent Nos.4 to 6 even in spite of the contents of the complaint clearly disclose the commission of the cognizable offences as arbitrary, illegal and contrary to section 173 of BNSS and consequently direct the Respondent No.1 to register the FIR based on the complaint dated 07.06.2025 made by the Petitioner against the Respondent Nos.4 to 6 forthwith and proceed with the investigation in accordance with law in the interest of justice…”
2. Learned Assistant Government Pleader for Home, on instructions, would submit that the Police have not registered the crime on the representation of the petitioner, since the matter is of civil in nature. 3. Recording the same, the Writ Petition is disposed of. However, the petitioner is at liberty to work out the remedies according to law before the appropriate forum. No order as to costs.
