ORDER:
The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of BNSS., has been filed by the Petitioner/Accused, seeking quashment of the proceedings pending against him in S.T.C.No.4729 of 2023 on the file of Special Magistrate-III at Visakhapatnam, for the offences punishable under Section 138 of the Negotiable Instruments Act, 1881.
2. Heard Sri N.Venkata Ramarao,
learned counsel for the Petitioner/Accused and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.
3. The present petition is filed by the complainant at the fag-end of the case in S.T.C.No.4729 of 2023, i.e., after submission of the written arguments by the learned counsel for the respondent therein. Further, the petitioner herein had failed to mention about the evidence about which he is intending to place before this Court. In view of the same, this Court is of the opinion that the order passed in S.T.C.No.4729 of 2023, by the learned Special Magistrate-III, Visakhapatnam is a well reasoned order and it does not brook any interference of this Court while exercising the jurisdiction under Section 482 of the Code of Criminal Procedure, 1973.
4. In view of the aforesaid reasons, the Criminal Petition is disposed of at the stage of admission without causing any prejudice to the rights and
contentions of the petitioner/accused.
