1. Heard Mr. M.U. Mahmud, learned counsel for the petitioner and Mr. M. Ali, learned counsel for the respondent no.2/informant. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State. 2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, 1. Gopal Sutradhar, has prayed for grant of bail in connection with Merarchar P.S Case No. 25/2025 registered under Sections 329(4)/64/296/351(2)(3)/3(5) of BNS, R/W Section 4 of the POCSO Act, 2012. 3. As reflected in the last order dated 26.09.2025, charge-sheet has been submitted vide Charge-sheet No.31/2025 dated 30.07.2025. 4. The allegations in the FIR dated 08.06.2025 is that the accused no.1 i.e. the present petitioner committed rape upon the informant’s minor daughter. Two other accused persons including the father of the petitioner were also arrayed as accused but in the meantime, they were not sent up for trial as per the information received by the learned counsel for the petitioner. 5. The scanned TCR has been received. 6. Mr. M. Ali, learned counsel for the respondent no.2/informant, supports the affidavit annexed with the bail petition, whereby the informant is not objecting to the grant of bail. 7. The accused is stated to have been in custody for 69 days. Page No.# 3/3
8. Considering all the factors, I deem it fit to allow bail to the accused at this stage. 9.
Accordingly, the above-named accused is allowed to go on bail of Rs.30,000/- (Rupees Thirty Thousand) only with one surety of like amount subject to the satisfaction of the concerned learned court with following conditions: (i) That the accused shall be available for the remaining trial; (ii) That the accused shall not harass or harm the informant/victim and their family members in any manner; (iii) That the accused shall not hamper or tamper with evidence. 10. Violation of bail conditions might entail cancellation of the bail. 11. With the above observations, this bail petition stands allowed and stands disposed of. JUDGE Comparing Assistant
