Paramanik, learned counsel for the petitioner and also heard Mr. R. J. Baruah, learned Addl. P.P. for the State. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, Martazul Khan, who was arrested on Page No.# 2/3 14.11.2025 praying for grant of bail in connection with Hajo P.S. Case No.478/2025 under Sections 306/ 316(2)/ 316(3)/ 317(2)/ 318(4)/ 112(2)/61(2)/3(5) of BNS, 2023. 3. The allegations is about diverting the truck loaded with batteries and related machines and stealing the same. The prime accused is stated to be driver and handyman of the vehicle. Four accused are named in the FIR. Submitting a copy of the order dated 12.12.2025 passed by learned JMFC, Mr. Paramanik learned counsel for the petitioner submits that the three of the co- accused FIR named have been granted bail with conditions. 5. The learned Addl. P.P. submits that the prime accused in this case are the driver and the handyman of the truck and some of the goods have been recovered, though investigation is going on. 6. Nevertheless, considering in the progress of investigation, the length of detention (since 14.11.2025) and the aspect of clarity- the present accused are allowed go on bail of Rs. 30,000/- with one surety of like amount to the satisfaction of learned JMFC, First Class, Hajo. 7. The direction for bail is further subject to the conditions: (a) That the accused person shall co-operate with the remaining investigation. (b) That the accused person shall not hamper or tamper with evidence; and (d) That the accused person shall not try to commit any illegal activities or offences 8. Violation or breach of any condition(s) shall entail cancellation of bail. 9. With the above observations, this bail petition stands allowed and Page No.# 3/3 disposed of accordingly. 10.
