This application filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, the accused petitioners namely, Alekh Singh and Ishwar Prasad Yadav, have prayed for bail in connection with Basistha P.S. Case No. 521/2025 under Section 61(2)/336(3)/340(2)/316(5) of BNS, 2023. 3. The present petitioners were arrested on 25.10.2025 and they are also named in the FIR along with one Manoj Kumar. 4. The gist of the allegations is that the petitioners indulged in fabrication of academic documents to enroll students under the PM Minority Cell Skill Development Scheme, whereby students received Rs.2,000/- per month and that, they indulging in such fraudulent activities illegally enrolled in such scheme, persons who did not fulfill the criteria and thereby misappropriated of Government funds and also deprived genuine beneficiaries. 5. The learned counsel for the petitioners submits that they have been examined and in custody since 54 days. It is also submitted that they are only the employees of the main accused Manoj Kumar; that the case is based on documentary evidence most of which have been seized. In this context, it is submitted that perhaps granting of bail at this stage may not be detrimental to investigation. 6. The learned Additional Public Prosecutor on the basis of received case diary objects to the grant of bail at this stage submitting that investigation has lend support to the allegation and revealed the wider Page No.# 3/3 network in this fraudulent activities of manipulating documents to confer benefits of the aforementioned Government scheme upon persons falling outside the criteria. It is also submitted that investigation is continuing into the involvement of other persons. 7. I have given my consideration to the materials as well as to the submissions. At this stage, I find force in the prosecution contention and therefore, this bail petition of the present accused is rejected at this stage. 8.
