Neutral Citation No. - 2025:AHC:31128 Court No. - 9 Case :- WRIT - C No. - 6564 of 2025 Petitioner :- Smt Shivani Kushwaha And 4 Others Respondent :- Presiding Officer Motor Accident Claims Tribunal South Kanpur Nagar And 3 Others Counsel for Petitioner :- Kartikeya Rajawat Hon'ble Rohit Ranjan Agarwal,J. This writ petition has been filed with the following prayer:-
"1. Pass a writ, order or direction in the nature of Mandamus to effectuate expeditious and time bound disposal of the claim petition bearing no. M.A.C.P. no. 1101 of 2017 (Smt. Shivani Kushwaha and others vs. Shri Shailesh Jain and others), District- Kanpur Nagar, pending before the respondent no. 1 i.e. Motor Accident Claims Tribunal (South), Kanpur Nagar." It is contended by learned counsel for the petitioners that Motor Accident Claims Petition is pending consideration since 2017 before Motor Accident Claims Tribunal. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondent, the matter is being disposed of, at the admission stage, with a direction upon Tribunal concerned to decide the pending M.A.C.P. no. 1101 of 2017 (Smt. Shivani Kushwaha and others vs. Shri Shailesh Jain and others) after hearing all the concerned parties, strictly in accordance with law, expeditiously, preferably within a period of six months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merits.
