State of Rajasthan and Ors., has submitted that the instant matter can be decided in light of Para-4 of Asha Sharma (Supra). Learned counsel for the respondents has not refuted the same. Since the matter is sub-judice before Division Bench of this Court, instant petition stands disposed of with the direction that disposal of instant petition would be governed by the outcome of the matter pending before the Division Bench of this Court in the case of Rakesh Sharma Vs.
