GP FOR HOME 2 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the inaction on the part of the 2nd Respondent in not initiating proceedings pursuant to the complaints of the Petitioner dt.03-8-2020 and 31-10-2020, against the 3rd Respondent U/Sec.217 IPC and Sec.3(2)(5a) of SC and ST(POA) Act, 1989, for the inaction on the part of the 4th Respondent in the capacity of the 3rd Respondent from proceeding further pursuant to the complaint of the Petitioner dt.13-7-2020 acknowledged vide Receipt No.491/2020, dt.13-7- 2020, given agaisnt Respondents 5 to 7, is nothing but arbitrary, unreasonable, unlawful and against to the Fundamental Rights of the petitioner under Article 21 of the Constitution of India and by further consequently directing the respondent No.2 to initiate action upon the complaints of the Petitioner dt.03-8-2020 and 31-10-2020 as per law.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, based on the complaints given by the Petitioner, 15 cases have been registered out of which three cases are referred as false and the remaining are under investigation. 3. Sri P.Rajesh Babu, learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioner to work out her remedies before appropriate forum. There shall be no order as to costs.
