The particulars of the courses successfully undertaken by the petitioners along with their duration of the course(s) are as under:- WP No. 18620 of 2025 Petitioners pursued 5-year MBBS University, Kyrgyzstan. The third academic virtual mode; the remaining years were attended physically. WP No. 19986 of 2025 course (2018-2023) from OSH State year was completed through Petitioners 1 to 4 were enrolled at V.l. Vernadsky Crimean Federal Russia (2017-2023), while Petitioner 5 petitioners completed approximately 12 months of their the pandemic and completed the remainder through physical mode. WP No. 19983 of 2025 University was enrolled from 2016-2022. All course online during Petitioners attended Columbus Central University School of Medicine (2018-2022) for 4.5 years.

It is contended by the petitioners that during the subject academic curriculum, the petitioners have not missed any practical classes, those practical sessions which they could not attend during pandemic were duly compensated and the University has also certified the same. 19 It has been argued by the learned Senior Counsel Sri Satya Prasad and the learned counsels Sri Nagireddy appearing for Sri Gajjala Mallikarjuna Reddy and Sri Amirisetty Sai Raghava, referring to the public notice(s) of the NMC dated 09-05-2023, particularly clause (ix) of the circular, respondent should not insist upon the petitioners to undergo 2'"'^ year internship. In most of the cases, it is in the 3"'^ year that the petitioners had to leave their Universities, on account of the pandemic, unlike the other cases. Therefore, after going back to the University, the petitioners had sufficient time to complete the course by attending physically to all the practical sessions, and the petitioners have not missed out any practical sessions. In the remaining cases also, the petitioners have compensatedthe classes that they have missed out. Sri Satya Prasad learned Senior Counsel further argues, placing reliance on the circular of the National Medical Council dated 04-03-2022 that the candidates who have joined their under graduate medical education in foreign institutions prior to 18th November, 2021, the Foreign Medical Graduate Regulations, 2021 would not apply. Therefore in the facts of the present cases in respect of those petitioners who have joined the Foreign Universities before 2021 FMG Regulations of 2021 would not

The learned counsels appearing for the petitioners that the facts in the said case would submit are different having regard to the fact that the petitioners in the said case have attended online classes during the semesters of 7, 8, 9, and 10, whereas in the present cases the petitioners have attended the online classes in 3'^'^ year and had sufficient time after going back to the University to compensate the classes that they could not attend while in virtual mode. It is further argued that the petitioners have also made several representations however the 1 respondent has not considered the representation of the petitioners. 13. Perused the record and considered the contentions advanced behalf of the petitioners and the respondents. on

A perusal of the public notice dated 19-06-2024 of the NMC would indicate that the same was issued clarifying its earlier public notice dated 07-06-2024, stating that the students who have sufficiently compensated the classes in physical onsite in lieu of online classes and subsequently passed examination equivalent to MBBS in India shall be
