IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH 223 CWP-4922-2019 Date of decision: 24.03.2025 LAL CHAND .........Petitioner
VERSUS
STATE OF HARYANA AND ANOTHER ........Respondents
CORAM : HON'BLE MR. JUSTICE VINOD S. BHARDWAJ ***** Present:- Mr. Sandeep Kumar Yadav, Advocate with Ms. Sangeeta Yadav, Advocate for the petitioner. Mr. Tapan Kumar, DAG, Haryana. ***** VINOD S. BHARDWAJ
, J. (Oral)
Prayer made in the present writ petition is for setting aside the order dated 30.01.2019 (Annexure P-7) whereby the claim of the petitioner was rejected and a further prayer to grant the benefit of IInd ACP from the year 2005 and IIIrd ACP as per ACP Rules, 1998.
Learned counsel appearing on behalf of the petitioner contends that the benefit of the ACP had been denied to the petitioner since he did not clear the Departmental test. He submits that similar controversy was brought before this Court in various writ petitions that were allowed by the Single Judge against which a batch of Letters Patent Appeals including LPA No. 1865 of 2015 were filed by the respondent-State of Haryana. The said aspect was considered by a VISHAL SHARMA 2025.03.27 13:39 I attest to the accuracy and integrity of this document
CWP-4922-2019 -2- Division Bench and the Letters Patent Appeal preferred by the State of Haryana has been dismissed since the respondent-State has granted the benefit of IInd and IIIrd ACP to the Patwaris who had not cleared the departmental exam for the post of Kanungo. Counsel for the respondent-State is not in a position to seriously dispute the applicability of the said judgment. The present writ petition is accordingly allowed in terms of the judgment dated 05.03.2025 passed in LPA No. 1865 of 2015 titled as “State of Haryana and others versus Parmanand and others”.
