JUSTICE ANOOP KUMAR DHAND Order 11/07/2025
1. A limited prayer has been made for issuing directions to the Rent Tribunal, Ajmer (for short ‘the Tribunal’) to decide the rent eviction application submitted by the petitioner under Section 9 of the Rajasthan Rent Control Act, 2001 (for short ‘the Act of 2001’) against the respondent.
2. Counsel submits that the aforesaid application was submitted before the Tribunal way back in the year 2019, wherein after recording statements of the petitioner, now the case has been posted for recording evidence of the respondent, but in-spite of passing of considerable time i.e. more than six years, till date, the said application has not been decided, hence, appropriate directions be issued to the Tribunal to speed up the proceedings of the said application.
(2 of 2) [CW-570/2025] Counsel submits that the petitioner is a senior citizen of the age about 66 years, therefore, appropriate directions be issued to the Tribunal.
3. Considering the arguments put forward by the learned counsel for the petitioner and looking to the fact that the application submitted by the petitioner under Section 9 of the Act of 2001 is lying pending for adjudication on its merits before the Tribunal since 2019 and looking to the age of the petitioner, who is a senior citizen, this Court deems it just and proper to dispose of the instant writ petition with the expectation from the Tribunal to make all possible endeavours to decide the pending application expeditiously, as early as possible, not beyond the period of 18 months from the date of receipt of certified copy of this order.
4. With the aforesaid observations, the instant writ petition stands disposed of. The stay application and all pending applications, if any, also stand disposed of.
