ORDER: The Criminal Petition, under Section 482 of the Bharatiya Nagarik suraksha sanhita, 2023, is filed on behalf of the petitioner/accused to grant anticipatory bail in connection with Crime No.929/2024 of Penamaluru Urban Police Station, Krishna District. 2) A case has been registered against the petitioner for the Offence punishable under Section 69 of B.N.S. 3) The case of the prosecution in brief iS that the defaCtO complainant got married on 04.03.2018 and blessed with a girl Child, and for last four years, they were living separately due to some disturbances and she was doing tailoring works in Yanamalakuduru Village. She got acquaintance with petitioner and his wife. Petitioner used to go to defacto complainant house and intimating with her Physically. When she shifted to Kaja Village of Movva Mandal, the petitioner went to her house and said deceitful words that he would marry her and took her to Poranki Village and rented in Kummari Bazaar. Petitioner took her gold ornaments and was frequently quarrelling with her threatening and harassing her mentally and physically, which resulted in defacto complainant becoming pregnant. 4) Heard. 2 5) A perusal of the nraterial available on record goes to show the defacto complainant and accused are neighbours and the defacto complainant was doing tailoring work. lntl®macy has been developed between the petitl'oner and the defacto complainant. It is alleged for more than a year, they continued their relatl'onshl'p. Thereafter, the Present complaint has been filed alleging that on the pretext of marrying her, the accused had sexual intercourse. Thereafter her pregnancy was also terminated. lt is submitted that on the intervention of elders, an undertaking has been given by the defacto complainant that she would go out from the life of the petitioner, on receivI'ng Rs.50,000/-. 6) Learned counsel appearing on behalfofthe petitionersubmits that there was an agreement between both the parties dated o8.7.2024. This Court perused the agreement in which the defacto complainant has CategOrl'CaIIy stated that she would not have any relationship with the accused in future and by statl'ng so she left the place on receiving Rs.50,000/-from the petitioner. In view of the developments that have taken place between the defacto complainant and the petl'tioner, this Court is incII'ned tO grant the Prayer Of the Petitioner for antiCI'PatOry bail.
7) Accordingly, in the event of his arrest with regard to this crime, Petitioner/accused Shall be released on bail on his executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only), with two sureties for the like sum each, to the satisfaction of the arresting police c==-_ `` i`±J,
3 rr officials, and also on condition that the petitioner shall make himself available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioner shall appear before the Station House Officer concerned, once in a week i.e. on every Saturday between 10.OO a.m. and o5.00 p.m., till filing of the charge-sheet. 8) Accordingly, the Criminal Petition is allowed.
