HC-KAR NC: 2025:KHC:21574 WP No. 15645 of 2025
CORAM: HON'BLE MR JUSTICE E.S.INDIRESH
ORAL ORDER The learned Additional Government Advocate accepts notice for Respondents No.2 to 4. 2. Heard the learned counsel appearing for the parties. 3. In this writ petition, the petitioner is assailing the order dated 15.01.2025, passed by Respondent No.2-Spl. Deputy Commissioner in RP No.64/2023 (Annexure-C), whereby the revision petition filed by Respondent No.1 has been allowed. 4. Upon careful examination of the order passed by Respondent No.2, it is evident that mutation entries were made on the basis of a Mortgage Deed as well as a registered sale deed dated
05.09.1966. The petitioner is claiming rights over the subject land based on a testamentary disposition. - 4 -

5.
In view of the above, considering the existence of disputed questions of fact relating to the title of the land in question, this Court finds no infirmity in the impugned order. Respondent No.2 has rightly allowed the revision petition filed by Respondent No.1. 6. It is, however, made clear that the petitioner is at liberty to approach the competent civil court to establish his right, title, or interest in respect of the subject land. With the above observations, the writ petition stands disposed of. SD/- (E.S.INDIRESH) JUDGE
