1. This Acquittal Appeal has been preferred under Section 14(A)(1) of the BNSS, 2023 against the judgment of acquittal dated 29.04.2025 passed by the Chief Judicial Magistrate, Rajnandgaon in RCC No.3147/2022, whereby, the respondent/accused has been acquitted of the charge under Section 294, 323 & 506 of the IPC.
2. At the outset, learned counsel for the appellant submits that the appellant has wrongly filed Appeal directly before this Court though there is a provision under Section 372 Cr.P.C (amended provision Section 413 of the BNSS), which specifically stipulates that an Appeal shall lie to the Court to which an Appeal ordinarily lies against the order of conviction of such Court, therefore, he seeks to withdraw this Appeal.
3. In view of the aforesaid submission of learned counsel for the appellant, this Appeal is dismissed as withdrawn.
4. Registry shall return the certified copy of the judgment and relevant documents to counsel for the appellant after retaining its photocopy.
