JUSTICE SOUMITRA SAIKIA ORDER 28.11.2025 Heard Mr. J Roy, learned Senior Counsel assisted by Mr. K Hazarika, learned counsel for the petitioner. 2. The petitioner is aggrieved by the impugned transfer order dated 11.11.2025 issued by the respondent no.3, whereby the writ petitioner, namely, Shri Anuj Kumar Regon has been transferred from Dhakuakhan ICDS Project to Silchar ICDS Project, Cachar. The petitioner’s grievance is that he was earlier transferred and posted at his last place of posting, Dhakuakhana, and now he is again being subjected to a transfer within a short span of 1 year and 8 months. He submits that such action is in violation of all Government notifications and guidelines and there is no specific reason as to why the petitioner has been transferred to Silchar. Pursuant to the order of transfer dated 11.11.2025, the petitioner filed a representation dated 19.11.2025 before the Additional Chief Secretary to the Government of Assam, Women and Child Development Department requesting for reconsideration of the transfer order. It is submitted that the petitioner has ailing parents and minor children. It is submitted that Page No.# 3/4 both his parents and also his wife are suffering from severe health ailments and they require constant medical treatments and checkups. That apart, one of his sons is appearing in the Class-X CBSE Board Examination which is scheduled to be commenced on 01.06.2026. It is further grievance of the petitioner that his salary from the year 2023 has not been paid. Under such circumstances, he had filed a representation dated 19.11.2025 before the Additional Chief Secretary to the Government of Assam, Women and Child Development Department to look into his grievances and reconsider the order of transfer dated 11.11.2025. However, that representation filed on 19.11.2025 has not been disposed of. Being aggrieved, the present writ petition has been filed. 3. After submitting for a while Mr. J Roy, learned Senior Counsel assisted by Mr. R Hazarika, learned counsel for the petitioner submits that at this stage the respondents be directed to dispose of the representation and till such time, the impugned transfer order dated 11.11.2025 be kept in abeyance. 4. Mr. TC Chutia, learned Additional Senior Government Advocate, Assam appearing for the State respondents submits that writ petition can be disposed of permitting the respondents to dispose of the representation submitted by the petitioner as expeditiously as possible. However, no interim order be issued, as in terms of the Government circular, the petitioner is required to proceed and join at his place of posting. Page No.# 4/4 5. Considering the submissions made by the learned counsel for the parties and considering the fact that there appears to be a representation pending before the concerned authority, which is shown to have been received by the Departmental authority, this Court finds it appropriate to close the writ petition at this stage without expressing anything on it’s merits by directing the Additional Chief Secretary to the Government of Assam, Women and Child Development Department to look into the grievances ventilated by the petitioner by way of representation being filed on 19.11.2025 and dispose of the same by 19.01.2026. The petitioner shall furnish a certified copy of the order to the concerned Authority. Any such speaking order that is passed, needless to say it shall be served on the writ petitioner. The impugned transfer order dated 11.11.2025 shall not be given effect to till 19.01.2026. 6. With the above observations and directions, the writ petition stands disposed of.
