Present Writ Petition has been filed under Article 226 of the Constitution of India with the following prayers :- “(i) Issue a writ, order or direction in the nature of certiorari quashing the order dated 10th of December, 2024 to the extent it passes an order that the licence of the petitioner for the Indian Made Foreign Liquor Shop, Durgapuri/ Gamandpur has been cancelled settling the liability of balance revenue on the petitioner Annexure No.6. (ii) Issue a writ, order or direction in the nature of certiorari quashing the order dated 20th of December, 2024, whereby, a recovery 2025:UHC:1123 2 of Rs.4,49,22,758/- is sought to be recovered from the petitioner, Annexure No.7. (iii) Issue any suitable writ, order or direction which this Hon’ble Court may deem fit and proper under the facts and circumstances of the case. (iv) Award costs of the petition to the petitioner.” 2. Mr. Sandeep Kothari, Advocate has requested to permit the petitioner to withdraw the present writ petition granting liberty to the petitioner to file an appeal under Section 11(1) of the United Provinces Excise Act, 1910 (as applicable in the State of Uttarakhand) within one week from today. 3. The said request has not been opposed by the respondents. 4. The present writ petition is dismissed as withdrawn granting liberty to the petitioner to file an appeal under Section 11(1) of the United Provinces Excise Act, 1910 by 28.02.2025 but in accordance with law. 5.
