This is the first bail application filed under Section 483 of the Bhartiya Nagrik Shuraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested on 28/09/2024 in connection with Crime No. 103/2024, registered at Police Station Tapkara, (Chowki-Kardega), District Jashpur, C.G. for the offence punishable under Sections 103 (1), 238 (A), 61 (2) (A) of B.N.S. 2. The case of the prosecution in brief is that on 26/09/2024 the police received information of dead body of one Bajrang Yadav was lying in ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2025.02.01 11:31:40 +0530 2 / 2 Rangadeepa Jungle, thereafter, the police started investigation and on suspicion the accused persons were arrested by the Police. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case and he has not assaulted the victim and he tried to rescue the victim. He would next contend that the police has not seized any weapon from the applicant and the only allegation against the applicant is that he had caught hold the hand of the deceased. He would lastly contend that the applicant is in jail since 28/09/2024, therefore, he may be released on bail. 4. Per contra, learned State counsel as well as learned counsel for the objector oppose the prayer for grant of bail and they would submit that the applicant has actively participated in the commission of murder of the deceased Bajrang and at the time of strangulation of the neck of Bajrang, the present applicant had caught hold of the deceased. 5. I have heard learned counsel for the respective parties at length and perused the documents. 6. Considering the entire facts & circumstances of the case and the allegations leveled against the applicant as he was involved in the murder of the deceased, I am not inclined to release the applicant on bail. 7.
