[1] This present miscellaneous case proceeding has been initiated by the applicant/petitioner as under section 151 of the Code of Civil Procedure whereby in this application seeking for the dispensation with the production of certify copy of the order dated 12.08.2025 rendered by the learned Single Judge on the writ side in WP(C) No.529 of 2025 at the time of filing an appeal which is indicated in this application. [2] Heard the Learned senior counsel for the applicant, Mr. N. Ibotombi and similarly, Mr. B.P Sahu, learned senior counsel for the respondents. [3] Perused the reasons stated in this application and whereby in this application seeking for dispensation of production of the certify copy of the order rendered by the learned single judge on the writ side. JOHN TELEN KOM Digitally signed by JOHN TELEN KOM Date: 2025.12.08 02:35:02 -08'00' 2 [4] However, this proceeding has been initiated as under section 151 of the Code of Civil Procedure whereby seeking for exercise in inherent power, there is no limit to exercise the inherent power, either effecting or affecting any order under this code, that is the first limb of the said provision of law, the second limb of the said provision of law relating to preventing the abuse of process of law, whereas the third limb of the said provision is seeking for securing the end of the justice and it is applicable to both the parties to the proceeding. However, in this proceeding seeking for dispensation of production of certify copy of the order dated 12.08.2025. [5] Keeping in view the scope of set up provision of law, it is deemed appropriate that this proceeding is hereby considered in the interest of justice. [6] Accordingly, dispensation to production of document as sought for in this proceeding by filing an application under section 151 Code of Civil Procedure, this application is hereby disposed of. [7] In pursuance of the disposal of this miscellaneous case proceeding is concerned, it is deemed appropriate that Registry be directed that, if any, and that appeal proceeding is to be listed in accordance with law.
