This writ petition is filed under Article 226 of the Constitution of India for the following relief:
“….. to issue a Writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not consider petitioner candidature to appoint as CRT (Telugu) since the candidate at Sl.No.1 in merit list given unwillingness for the said post vide Recruitment Notification No. 01/KGBV/APSS/2024, dated 23.09.2024 and deny to appoint the petitioner as CRT (Telugu) is illegal arbitrary, unjust and violative of Art 14, 19(1)(g) and 21 of the Constitution of India and consequently direct the respondents to appoint petitioner as CRT Telugu)
and continued her service until completion of their contract agreement for the ensuring academic year and pass…”
2. Heard Sri Pamarthy Ratnakar, learned counsel appearing for the petitioner and learned Government Pleader for Services-III appearing for the respondents. 3. On hearing, learned counsel submits that the respondents have issued Recruitment Notification dated 23.09.2024 inviting applications for filling up the posts of Principal, PGTs, CRTs, PETs on contract basis and Accounts, Wardens and Part Time Teachers on outsourcing basis for the academic year 20224-2025 of teaching and non-teaching posts in 352 type-III KGBVs and 145 type-IV KGBVs located across the state. He submits that the respondents have issued the above notification in terms of the Services Rules issued in G.O.ms.No.68 School Education (Exams) Department dated 26.10.2018. He further submits that the petitioner herein has applied for the post of CRT (Telugu) thereafter respondents have issued the provisional merit list wherein the petitioner stood at Sl.No.2 and in final merit list the petitioner stood at Sl.No.2 also. He further submits that the respondents have selected the candidates under 1:3 ratio wherein the candidate under Sl.No.1 named Vasadi Padma was given unwillingness to CRT (Telugu) and joined CRT (Biology) and CRT (Telugu) was fall under vacant.
By knowing the same, the petitioner has submitted a representation to consider her candidature to appoint as CRT (Telugu) , but the respondents have not taken any action on the representation of the petitioner. Thereafter the respondents issued a proceeding vide Rc No.64/C3/GCDO/SS/2024, dated 13.12.2024 wherein it was stated that the file
was in process for selecting and appointing the petitioner as CRT (Telugu). But, no action has been taken by the respondents, so far. Therefore, learned counsel for the petitioner requests this Court to pass appropriate orders,

Learned Government Pleader appearing for the respondents has furnished a copy of proceedings in Lr.Rc.No.1105/C3/KGBV/ SS/2024, dated 06.01.2025, and submits that, the file is under circulation and submitted to the approval of the Collector & Chairman, Samagra Shiksha to consider the candidature of the petitioner. Soon after getting approval from the District Collector & Chairman, Samagra Shiksha, Vizianagaram, the candidature of the petitioner will be considered to engage her in the post of CRT (Telugu) in the available vacancy in KGBV in the District. Therefore, learned Government Pleader requests this court by recording the above submission, the present writ petition may be closed. 5. Recording the above submission of learned Government Pleader, the Writ Petition is closed. No costs.
