This is an application seeking impleadment of one Sri Akash Deep, IAS, Secretary, Welfare of Bodoland Department, Govt. of Assam, as contemnor respondent No.3 in the connected Cont.Cas(C) 50/2021. The applicant filed the connected Cont.Cas(C) 50/2021 alleging willful and deliberate violation of the order dated 04.03.2020 in I.A.(Civil) 3522/2017 arising out of WP(C) 403/2017, wherein, three persons have been impleaded as alleged contemnor. It is submitted that the alleged contemnor No.3, who was earlier serving as Secretary to the Govt. of Assam, Welfare of Bodoland Department has been transferred therefore, the present incumbent would be a necessary party in the contempt proceeding. Mr. S. Bora, learned counsel for the respondent No.1 submits that he has no objection to the impleadment as the officer sought to be impleaded is the present incumbent. Having considered that Sri Akash Deep, IAS, is stated to be presently serving as Secretary, Welfare of Bodoland Department, he would be required to be impleaded as respondent No.3 in the connected Cont.Cas(C) 50/2021, I deem it appropriate to allow the Interlocutoary Application. Accordingly, Sri Akash Deep, IAS, Secretary Welfare of Bodoland Department Dispur is allowed to be impleaded as respondent No.3 in the connected Cont.Case(C) 50/2021.
