1. Heard Mr. A. K. Bhuyan, learned counsel for the petitioner and Mr. R. J. Barah, learned Additional Public Prosecutor, Assam. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the
Page No.# 2/3 accused-petitioner, namely, Alpaz Ahmed Talukder, praying for grant of bail in connection with Hatigaon P.S. Case No.191/2025 under Sections 318(4)/316(2)/3(5) of the BNS, 2023. 3. The allegation in the FIR dated 29.10.2025 was that an amount of Rs.5,50,000/- was missing from the pension account of her husband and that it was alleged that the petitioner, who was an employee of the bank had transferred the amount from his account to his mother’s account, Ruby Begum. 4. Drawing attention to the relevant document, Mr. Bhuyan, learned counsel for the petitioner submits that in the meantime, the parties have arrived at a settlement whereby the informant has stated in an affidavit that she had given that the same amount of Rs.5,50,000/- as loan to the accused petitioner and that has been returned. 5. Case diary has been received. 6. Mr. Baruah, learned Additional Public Prosecutor drawing attention to the relevant portion of the case diary submits that the said agreement is also reflected in the case diary. 7. I have perused the pointed out portion in the case diary indicating in the statement of the complainant about receiving the said money and expressing her unwillingness to proceed with the case. The petitioner has already spent 46 days in custody. 8. In that circumstances, it is provided that the accused petitioner, named above, shall be released on bail of Rs.15,000/- with one suitable surety of like amount to the satisfaction of learned concerned court subject to the following conditions that the petitioner: (a) shall co-operate with the process of law

9. Accordingly, this bail application stands allowed and disposed of.
