This writ petition has been filed with the following prayer:- "I. To direct the Civil Judge (Junior Division), Jalesar Etah to decide injunction application No. 6C-2 and Application No. 27C-2 in Original Suit No. 150/2023 Sanjay Kumar vs. Viresh Kumar and restrain the respondent from interfering in use and occupation plaintiff/petitioner over the bhoomidari land of Arazi No. 932/7, admeasuring 0.809 H (having 1/8th share), situated in Barai Kalyanpur, Tehsil Jalesar, District Etah." It is contended that an application 6-C2 and application 27-C2 are pending consideration in the suit instituted by plaintiff-petitioner. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction upon Civil Judge (Junior Division), Jalesar, Etah to decide the application 6-C2 in Suit No.150 of 2023, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order. Further, the Civil Judge (Junior Division), Jalesar, Etah is directed to decide the application 27-C2 filed under Order 8 Rule 10 CPC in Suit No.150 of 2023 within a period of four months from the date of production of certified copy of this order after hearing all the concerned parties, in accordance with law. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
