These instant bail applications have been filed under Section 483 of BNSS on behalf of the petitioners, who have been arrested in connection with FIR No.0178/2024 Police Station Roopangarh, District Ajmer (Raj.) for the offences punishable under Sections 103(1), 109(1), 115(2), 126(2), 111(2)(a), 190, 191(2), 191(3), 308(4), 326(f), 61(2)(a), 189(2), 189(4), 324(4) of BNS 2023 and Section 3/25 of the Arms Act. 2. It is contended by learned counsel for the petitioners that petitioners have falsely been implicated in this case. He submits that the petitioners are not named in the FIR. The allegation of causing fire-arm injuries on the person of the deceased and other injured is against co-accused-Dinesh Choudhary. Counsel further submits that the petitioners have been charge-sheeted with the aid of Section 61(2)(a) of BNS (120B of IPC). Further custody of the petitioners would not serve any fruitful purpose. Charge-sheet has already been filed. There is no criminal antecedents against the petitioners. 3. Learned Public Prosecutor vehemently opposes the submissions made by the learned counsel for the petitioners. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, especially the fact that the petitioners are not named in the FIR, charge-sheet has been filed, period of custody and absence of criminal antecedents, but without [2025:RJ-JP:1416] (3 of 3) [CRLMB-235/2025] commenting anything on the merits/demerits of the case, I deem it proper to allow these bail applications. 6. These bail applications are accordingly allowed and it is directed that accused-petitioners – 1. Parvati Devi W/o Shri Balbharam, 2. Shriram S/o Shri Ghanshyam, 3.
