1. Heard Mr. T. Deuri, learned counsel appearing for the accused petitioner as well as Mr. D. P. Goswami, learned Additional Public Prosecutor, Assam.

2. By this petition under Section 483 BNSS, the accused-petitioner, namely, Binay Kalita @ Langku who was arrested on 06.10.2025 in connection with Chandmari PS Case No. 239/2025 under Section 103(2) of BNSS is seeking bail.
3. The gist of the allegation is that on 02.10.2025 when the informant’s brother was returning after immersion of the Durga Idol, he was badly attacked by 30-40 persons and brought to KGMT Hospital where he succumbed to his injuries.
4. It is submitted by the learned counsel for the petitioner that the present petitioner is not a participant of the assault.
5. Mr. D. P. Goswami, learned Additional Public Prosecutor submits that the post-mortem report reveals multiple injuries on the person of the deceased and there is also incriminating material against the present petitioner regarding participation of the present petitioner in the alleged assault upon the deceased.
6. Having regard to the above, prayer of bail stands rejected at this stage.
7. Return the case diary.
8. The bail application stands disposed of.
