1. The applicant has preferred this First Bail Application under Section 483 of BNS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 52/2024, registered at Police Station Badanji, District- Bastar (CG) for the offence
2 punishable under Section 296, 115(2), 103(1) 3(5) of BNS, 2023. 2. The prosecution story in brief is that on 16.09.2024, the complainant Smt. Lalita Yadav lodged a report at P.S. Badanji to the effect that at about 9:00 pm she along with her son Parmeshwar Yadav went to the house of Dayaram Yadav of the village and was talking to him saying that they have taken more land, at that time Dayaram and his sons Haldhar and Balram got angry and abused her and her son Parmeshwar and beat them and killed her son by hitting him on his head with tangia. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The applicant is in jail since 17.09.2024. Also, the trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicants. 4. On the other hand, learned counsel for the State opposes the bail application and contended that the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.
Accordingly, the bail application of applicant- Haldhar Yadav involved in Crime No. Crime No.
3 52/2024, registered at Police Station Badanji, District- Bastar (CG) for the offence punishable under Section 296, 115(2), 103(1) 3(5) of BNS, 2023 is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 8. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
