Learned APP submits that, it has already come on record in connected appeal No. 568 of 2019 that the present respondent No.1 in this application is no more and connected appeal has already been abated against him. 2. In view of the same, learned APP prays for deletion of name of respondent No.1 from the title clause of the application as well as Appeal Stamp No. 809 of 2019. 3. For the reasons stated in the application, the delay of 28 days caused in filing the appeal Stamp No. 809 of 2019 stands condoned. The application is accordingly disposed of. 4. Since the main accused Gorakshnath @ Gorakh Dadasaheb Aagam is no more and other accused are already on bail, present appeals 2025:BHC-AUG:24364-DB {2} CA 2683.19 SR.13.odt is removed from the category of “Jail Appeal” and be placed as per its turn. 5. Lateron, Mr. Salgare, learned APP brought to the notice of this Court that in the present appeal, this Court vide vide order dated 16.10.1999 had granted leave to file appeal only against respondent NO.1 Gorakshnath and refused to grant leave in respect of respondent Nos. 2 and 3, who are other accused. 6. Thus, now on death of respondent No.1 Gorakshnath, nothing survives in the present appeal i.e. Criminal Appeal Stamp No. 809 of 2019 and same is accordingly disposed of. [MEHROZ K.
