THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 18835 OF 2025
ORDER:- The Present Writ Petition is filed questioning the action of the Respondents 3 to 5 in not issuing appointment orders to the Petitioner for the post of Nutrition Counselor, though her name is stood at SI.No.1 in the final merit list, pursuant to the Notification No.3/SNCU-NRC-NBSU-DEIC/KNL/ 2023, dated 21.06.2023 as illegal and arbitrary.
2. The facts leading to file the present Writ Petition are as follows:- A Notification dated 21.06.2023 was issued by the Respondent No.4 for recruitment of certain posts, among them, one of the posts called Nutrition Counselor’. The Petitioner having requisite qualifications had applied and she secured highest marks and stood at SI.No.1 in the select list issued in the year 2023 for the said post. However, posting
order was not issued to the Petitioner, the present Writ Petition came to be filed.
3. Learned Assistant Government Pleader for Services-I for the Respondents had passed on signed written instructions of Respondent No.4 dated 24.07.2025, wherein it is mentioned that the appointment order would be issued to the Petitioner and delay was on account of administrative delay. The relevant portion of the written instructions extracted below:
“Consequently, due to the Administrative delay, the aspirant Smt. R. Sai Durga who stood in the Merit with 57.86% has filed the Writ Petition No. 18835/2025 in the High Court of A. P vide reference cited.
Hence, it is submitted that, if the Hon’ble High Court of A.P pleases, the appointment Orders will be served to the aspirant Smt. R.Sai Durga who stood in merit with 57.86% for 01 Post (OC Women) of Nutrition Counselor, so as to avoid further legal complications”.
4. In view of the facts referred above, the Respondent Authorities shall issue posting order to the Petitioner as expeditiously as possible, while recording the written instructions dated 24.07.2025 placed on record.
5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
