Heard Mr. M Dutta, learned counsel for the petitioner. Also heard Ms. M. Bhattacharya, learned Additional Senior Government Advocate, Assam and Mr. A Phukan, learned Standing Counsel, GAD and Mr. S Dutta, learned Standing Counsel, Revenue Department.
Learned counsel for the respondents has placed before the Court the
order No. GAD-642768/281 dated 31.10.2025, whereby the Departmental Appeal preferred by the petitioner stood dismissed. A copy of the said order is placed before the Court and kept on record. Mr. M Dutta, learned counsel for the petitioner, therefore, submits that he be permitted to withdraw the petition and file it afresh. Prayer made is not objected to by the learned counsel for the respondents. Accordingly, the writ petition stands dismissed on withdrawal with liberty.
