1. The accused/applicant has moved this first bail application under Section 483 of BNSS, 2023 for releasing him on regular bail during trial in connection with Crime No. 172/2024 registered at Police Station - Bhatgaon, District – Sarangarh-Bilaigarh (C.G.) for the offence punishable under Sections 137(2), 87, 65(1), 64(2-M) of BNS and Sections Digitally signed by HEERA LAL SAHU Date: 2025.07.16 10:27:12 +0530
2 3/4(2) & 5(L)/6 of Protection of Children from Sexual Offences Act.
2. The victim along with her father appeared through video conferencing from the concerned DLSA and raised their objection to grant bail to the applicant.
3. At the outset, learned counsel for the applicant submits that he wants to withdraw this bail application and prays for direction to the trial Court to expedite the trial and conclude the same as early as possible, as the applicant is in jail since 06.01.2025.
4. Learned State counsel has no objection to this proposition put forth by the counsel for the applicant.
5. Prayer is allowed.
6. Accordingly, this bail application is dismissed as withdrawn.
7. However, considering the fact that the applicant is in jail since 06.01.2025, the concerned trial Court is directed to expedite the trial and to ensure that the trial is concluded as expeditiously as possible.
