The applicant herein has filed the present application u/s 528 B.N.S.S. for quashing of the entire of Criminal Case No. 2070 of 2022, Computer Case No.1309047 of 2022, (Firm Kalyandas Rajeev Kumar vs. Madhuri Devi & another), under Section 138 of the Negotiable Instrument Act, P.S. Kotwali, District Hathras, pending before learned Chief Judicial Magistrate, Hathras. 3. Sri Kuldeep Kumar Dube, learned counsel for the applicant seeks to withdraw the present application wherein challenge has been raised with liberty to file fresh on account of technical inherent defects. However, he submits that the certified copy be returned subject to furnishing of the photocopy. 4. Learned AGA has no objection to the same. 5. The application is dismissed as withdrawn with aforesaid liberty. 6. Office is directed to return the certified copy of the document which has been filed subject to furnishing of the photocopy.
