KOLLI CHINNAMMI, - ...RESPONDENT THE COURT MADE THE FOLLOWING JUDGMENT: The Second Appeal is preferred by the appellant against the Judgment and Decree dated 18.12.2001, passed in A.S.No.69 of 2001, on the file of the learned Additional District Judge, Vizianagaram, confirming the Decree and Judgment dated 30.04.2001, passed in O.S.No.16 of 1994 on the file of the learned Junior Civil Judge, Gajapathinagaram. 2. Learned counsel appearing on both sides are present. 3. Learned counsel for the respondent submits that sole appellant died and memo dated 19.11.2014 has also been filed to that effect. On perusal of the memo dated 19.11.2014, it shows that sole appellant died on 09.11.2014. 4. Inspite of lapse of period of 9½ years, steps have neither been taken to implead the legal representatives of deceased sole appellant nor legal representatives have themselves came on record to proceed the matter further. 5. It seems that the legal representatives of deceased sole appellant are not showing interest to prosecute the matter and without proper representation from both sides, this Court could not proceed further. 6. In the result, the Second Appeal is dismissed as abated. There shall be no order as to costs. Interim orders granted earlier, if any, shall stand vacated.
