BEFORE HONOURABLE MR. JUSTICE KARDAK ETE ORDER Date : 24-11-2025 Heard Mr. M. Hussain, learned counsel for the petitioner. Also heard Mr. B. Gogoi, learned Additional Advocate General for the State respondents and Ms. R. H. Choudhury, learned Standing Counsel, Assam Legal Service Authority for the respondent No. 3. The petitioner is the wife of one Late Farhadul Islam @ Forhadul Islam, who was killed in an incident occurring between 13.02.2010 to 14.02.2010, resulting in registration of Bilasipara Police Station No. 143/2010, under Section 302 of the Indian Penal Code. It is the contention of the petitioner that under the Victim Compensation Scheme, on application, the petitioner was initially paid an interim compensation amount of Rs. 1,25,000/- on 21.01.2020. Thereafter, vide an order dated 10.12.2024, the District Legal Service Authority, Dhubri has passed the final order allowing an amount of Rs. 5,00,000/- as compensation. Mr. M. Hussain, learned counsel for the petitioner, submits that though the interim compensation amount of Rs. 1,25,000/- has been paid, the remaining amount of Rs. 3,75,000/- has not been released to the petitioner despite the final order dated
10.12.2024. Therefore, he prays for a direction to release/ disburse the remaining amount of Rs. 3,75,000/- as final victim compensation amount. Mr. B. Gogoi, learned Additional Advocate General, and Ms.
R. H. Choudhury, learned Standing Counsel, Assam Legal Service Authority, have fairly submitted that
Page No.# 3/3 since the petitioner is entitled to be paid the compensation under the Victim Compensation Scheme and the final order having been passed by the concerned authority vide order dated 10.12.2024, the competent authority may be directed to release and disburse the remaining amount of Rs. 3,75,000/- to the petitioner within a reasonable time. Having considered the submissions and the fact that the petitioner is entitled for compensation under the Victim Compensation Scheme and the petitioner having been paid the interim compensation of Rs. 1,25,000/- and thereafter a final order having been passed on 10.12.2024, I deem it appropriate to dispose of this writ petition with a direction to the respondent authorities to release and disburse the amount of Rs. 3,75,000/- as final compensation amount to the petitioner. Accordingly, the respondents are directed to release and disburse the remaining compensation amount of Rs. 3,75,000/- to the petitioner within a period of 2 (two) months from today.
