Lahkar, learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 528 of the BNSS 2023 in respect of Page No.# 2/3 Special Case No. 367/2023 pending in the court of Special Judge (Addl.), Dhubri. 3. The petitioner, namely, Nurjamal @ Lau @ Nurjamal Sheikh has been shown as an absconder in the Charge Sheet. It is an offence relating to possession of commercial quantity of narcotic drugs. 4. Mr. Lahkar, learned Additional Public Prosecutor for the State of Assam has objected to this bail application only on the ground that commercial quantity of narcotic drugs was recovered by police. 5. The petitioner submits that he is interested in facing the trial and therefore, he deserves to be given an opportunity to that effect. 6. The Court has considered the submissions made by the learned counsels for both sides. 7. Since the petitioner is interested in facing the trial, he deserved to be given one opportunity to that effect. 8. Therefore, his application is allowed. 9. The warrant of arrest issued against him shall be recalled. 10. It is hereby directed that the petitioner, namely, Nurjamal @ Lau @ Nurjamal Sheikh shall appear before the Court of the Learned Special Judge Page No.# 3/3 (Addl.), Dhubri, in connection with Special Case No. 367/2023 within next 7 (seven) days from today and on his appearance he shall be released on bail of Rs. 50,000/- (Rupees Fifty Thousand) with a surety of the like amount to the satisfaction of the Learned Special Judge (Addl.) Dhubri. 11. The criminal petition is accordingly disposed of. JUDGE Comparing Assistant
